Entity Definition and Application The domain name thetravelfoot.in (and its subsequent extensions, hereinafter referred to as the “Website”) is owned and operated by The Travel Foot Adventures Pvt. Ltd. For the purposes of these Terms & Conditions (“T&C”), the Privacy Policy, Disclaimer, and all associated legal frameworks, “The Travel Foot” (also referred to as “we,” “us,” or “our”) refers collectively to the registered corporate entity, The Travel Foot Adventures Pvt. Ltd., a company incorporated under the Companies Act, 2013, with its registered office at 22, Upper Kolhupani, Chandrawani Khalsa, Pondha Road, Dehradun, Uttarakhand – 248007, India.

Welcome to The Travel Foot! By accessing our Website or booking any trek, tour, or service with us, you (“User,” “You,” or “Traveler”) acknowledge that you have read, understood, and agreed to the following legally binding Terms & Conditions.

1. The Booking Contract & Quotations

1.1 The Final Quotation: Prices listed on the Website are subject to seasonal fluctuations. A formal Quotation will be issued detailing your specific itinerary, inclusions, exclusions, and total cost. Once full or partial payment is made against this Quotation, it constitutes the final binding contract, superseding any prior verbal, written, or website communications. 1.2 Payment Terms: All bookings must be made through our official channels. Bookings are confirmed only upon receipt of a 30% advance of the Invoice Amount. The remaining 70% must be cleared at least 15 days prior to your scheduled trip start date. 1.3 Payment Defaults: Failure to make timely balance payments may result in the automatic cancellation of your booking without a refund of the advance deposit.

2. Role of The Travel Foot & Service Providers

2.1 Tour Coordination: The Travel Foot acts as a Principal Tour Operator. While we design, coordinate, and oversee the execution of your itinerary, we contract with independent third-party Suppliers (local hotels, transport operators, regional guides) to deliver specific ground components. 2.2 Price Adjustments: Prices are based on current vendor rates. Any significant, unforeseen rise in costs (e.g., state fuel surcharges, sudden accommodation fee hikes, or new government taxes) prior to departure will be passed on to the traveler.

3. Cancellation & The Travel Foot Wallet Policy

Because we commit funds to local vendors well in advance, we strictly adhere to our operational cancellation framework. All eligible refunds are issued exclusively as a Travel Foot Wallet Voucher (no cash refunds).

3.1 Cancellation & Deduction Schedule:

  • 30+ days before departure: 15% deduction. (85% refunded as a Voucher, valid for 18 Months).
  • 20–29 days before departure: 25% deduction. (75% refunded as a Voucher, valid for 15 Months).
  • 15–19 days before departure: 35% deduction. (65% refunded as a Voucher, valid for 15 Months).
  • 10–14 days before departure: 50% deduction. (50% refunded as a Voucher, valid for 12 Months).
  • 7–9 days before departure: 65% deduction. (35% refunded as a Voucher, valid for 12 Months).
  • 0–6 days before departure: 70% deduction. (30% refunded as a Voucher, valid for 6 Months).

3.2 Wallet Voucher Rules: Vouchers are non-transferable on secondary markets but may be formally gifted to a family member via written email request. They must be redeemed to settle the due amount on a new booking and cannot be exchanged for cash.

4. Itinerary Changes, Delays & Force Majeure

4.1 Unforeseen Events: The Travel Foot is not responsible for itinerary changes, delays, or cancellations caused by natural disasters, landslides, adverse weather, government regulations, flight/train disruptions, pandemics, or political unrest (Force Majeure). 4.2 Additional Costs: If an itinerary must be altered due to safety or Force Majeure, we will arrange the best possible alternatives. However, the traveler assumes sole financial responsibility for any additional costs incurred (e.g., extra hotel nights, alternative transport, or extended food expenses). 4.3 Approximations: Trekking distances, drive times, and altitudes listed in itineraries are approximate and may vary due to road conditions, weather, or group pacing. 4.4 Unused Services: No refunds or reimbursements will be provided for unused services (missed hotel stays, sightseeing, or meals) if a trip is interrupted, cut short, or voluntarily abandoned by the traveler.

5. Travel Documents, Health & Insurance

5.1 Mandatory Documents: Travelers must possess all necessary documents, including valid ID/passports and state-mandated permits. We are not liable for trip disruptions resulting from incorrect or missing documentation. 5.2 Medical Fitness Requirements: For high-altitude treks and adventure trips, travelers must obtain a medical fitness certificate from a certified MBBS doctor or registered Medical Officer. You must disclose all pre-existing conditions prior to booking. We reserve the right to deny participation to anyone deemed medically unfit. 5.3 Travel Insurance: Comprehensive travel insurance is highly recommended (and mandatory for high-altitude expeditions). The policy must cover medical evacuations (including helicopter rescue), trip interruptions, and personal liability. The Travel Foot will not bear any medical or evacuation expenses under any circumstances.

6. Traveler Conduct & Safety

6.1 Safety Compliance: Travelers must strictly follow all safety instructions provided by guides and local authorities. Helmets, life jackets, and harnesses must be utilized as directed during adventure activities. 6.2 Zero Tolerance Policy: The Travel Foot maintains a strict zero-tolerance policy against harassment, discrimination, verbal/physical abuse, or reckless behavior endangering the group. Violators will be immediately removed from the trip without a refund. 6.3 Intoxicants: The consumption of illegal drugs is strictly prohibited. Intoxication during trekking or adventure activities that poses a safety risk will result in immediate disqualification from the itinerary. 6.4 Property & Environment: Travelers are financially responsible for any damage or vandalism they cause to lodging or transport vehicles.

7. Media & Marketing Consent

7.1 Promotional Use: We may capture photographs and videos during trips for marketing and social media purposes. By participating, you grant The Travel Foot the right to use this media. 7.2 Opt-Out: If you do not wish to be photographed, you must explicitly inform the tour leader at the start of the trip, and we will respect your privacy.

8. Governing Law & Dispute Resolution

8.1 Jurisdiction: These Terms & Conditions and any resulting operational contracts shall be governed by the laws of India. Any disputes or legal matters will be subject to the exclusive jurisdiction of the courts in Dehradun, Uttarakhand, India. 8.2 Mediation: In the event of a dispute, both parties agree to attempt resolution through good-faith mediation prior to initiating legal proceedings under the Arbitration and Conciliation Act, 1996. 8.3 Claim Limit: Any formal claim or dispute must be raised in writing within seven (7) days of the trip’s completion.
